VP, Privacy Officer

The VP, Privacy Officer drives the management and resolution of privacy matters and provides sound advice related thereto, identifies risk, and provides support and guidance to the various business operations. This position leads the privacy program and is the primary advisor on privacy matters.  This position reports to the Chief Compliance Officer. 

Responsibilities 

Regulatory Responsibilities 

  • Maintains compliance with all applicable state and federal laws and regulations impacting privacy and is aware of those impacting the mortgage servicing business. 
  • Maintains and updates compliance inventory of federal and state laws and regulations that relate to mortgage servicing activities as well as FHA, VA, USDA, and GSE guidelines.
  • Owns the maintenance of the citation library.
  • Assists the relevant LOBs within the servicing operations with drafting and implementing policies and procedures to assure compliance with applicable laws, regulations, and investor requirements
  • Provides ongoing support for mortgage servicing operations and customer assistance related issues within servicing operations
  • Advises senior management servicing risks within the organization and devises practical solutions for any issues raised
  • Responds to regulators and auditors examinations and reviews
  • Supports other aspects of the Compliance Program as directed by the Chief Compliance Officer. This includes advisory services related to the Fairness of Cenlar’s mortgage servicing practices.

Privacy Program Responsibilities

  • Serves as Cenlar’s Privacy Officer by developing and leading the privacy program
  • Serves as the primary advisor and provides guidance and support to leadership and business units on matters concerning privacy
  • Monitors and assesses privacy risks and develops mitigation strategies to ensure long term compliance with existing federal and state privacy laws and requirements
  • Review and update Privacy Policies, procedures, controls and communications
  • Review privacy complaint-related responses
  • Oversee and monitor privacy practices and compliance
  • Coordinate with Business Resiliency Team for Privacy Incident Management including conducting investigations.
  • Perform annual risk assessment of Privacy and credibly challenge controls. 
  • Coordinate annual GLBA report to the Board
  • Coordinate escalation and reporting of privacy incidents
  • Works with managers to develop and monitor individual and departmental goals and provides effective feedback and guidance on a regular basis; Holds managers accountable for meeting these goals
  • Leads effective performance management and professional talent development across all respective departments
  • Appropriately assess risk when business decisions are made, including but not limited to compliance and operational risk. 
  • Demonstrate consideration for Cenlar’s reputation as well as our clients, by driving compliance with applicable laws, rules and regulations, adhering to Policy, applying sound ethical judgment regarding personal behavior, conduct and business practices, and escalating, managing and reporting control issues, as well as effectively supervise the activity of others and create accountability with those who fail to maintain these standards
  • Ensure all activities are in accordance with Cenlar’s approved risk appetite statement and applicable compliance and regulatory requirements.

Requirements

  • Bachelor’s degree or equivalent experience
  • J.D. and licensed member in good standing of the Bar of at least one U.S. state preferred 
  • 12+ years of experience in mortgage operations including previous experience managing multiple departments
  • Must have extensive knowledge of FDCPA, FCRA, RESPA, TCPA, TILA, and the Gramm Leach Bliley Act
  • In depth understanding of FHA, VA, USDA, GSE, and other servicing rules 
  • Possess strong knowledge in US privacy laws and requirements
  • ANSI Certified Information Privacy Professional (CIPP/US) required or actively pursuing
  • Strong leadership skills to inspire outstanding performance through collaboration
  • Strong customer service skills to effectively execute the strategic goals and mission of Cenlar, while demonstrating Key Success Factors
    Effective listening, communication, and presentation skills to present complex topics to senior management in a persuasive manner
  • Strong problem solving and analytical skills to come up with a mutually acceptable solutions utilizing available resources with diverse perspectives
  • Excellent coaching and counseling skills
  • Excellent organizational skills and ability to multitask to manage multiple large-scale complex projects enterprise-wide
  • Resourceful and aggressive ability to research all facets of the industry
  • Ability to plan strategically as it relates to business unit responsibilities
  • Ability to conceptualize long-term business goals and develop orderly process of planning to accomplish goals
